Rep. Lina Ortega Applauds Signing of HB 1410
Legislation Promotes Reunification in State’s CPS System
AUSTIN –Following last week’s signature by the Governor, Representative Lina Ortega released the following statement:
"I am grateful to have passed House Bill 1410, which ensures that children in our Child Protective Services system have the best possible chance of reuniting with their parents. This bill passed with unanimous support in both the House and the Senates, fixing an issue that has plagued the CPS system for many years.”
Current law relating to the timeframe of when foster parents can intervene in a suit between the Department of Family and Protective Services and the child’s parents contains a loophole, allowing foster parents to intervene prior to twelve months. Foster parents play an important role in our CPS system, but they were never intended to be allowed to intervene until after 12 months. HB 1410 upholds the intent of current law by closing that loophole and ensures that the goal of reunification of parents and children is preserved in our CPS system.
HB 1410 becomes effective on September 1st.
