OPEN CARRY LEGISLATION CLEARS FINAL HURDLE BEFORE BECOMING LAW  print page

AUSTIN – Open carry legislation, House Bill 910, cleared its final hurdle Friday evening after the Texas Senate adopted the bill’s conference committee report and now awaits the signature of Texas Governor Greg Abbott. HB 910 authorizes individuals with a concealed handgun license to openly carry a holstered handgun. The bill, initially filed by State Representative Larry Phillips, was co-authored by several members of the Texas House including State Representative Ron Simmons.

"As a strong supporter of Second Amendment rights, I believe the fundamental responsibility of government is to protect the lives and property of its people," said Simmons. "I am proud to have been a co-author of legislation which allows law abiding citizens of Texas to exercise their constitutional right to bear arms."

Texas has for many years been one of only six states restricting the open carry of a handgun. HB 910 remedies this while still ensuring those who wish to openly carry a handgun must obtain a license and outlines penalties for improper use.

"This legislation is the product of months of hard work by my colleagues in the House and Senate,” said Simmons. “I have heard from many in my district who have been waiting for this type of legislation to pass for some time and I feel this is a significant achievement not only those in District 65 but for gun owners across the state.”

HB 910 was voted out of the House with a 102-42 vote on April 20, 2015 and passed the Senate with a 210-11 vote on May 22, 2015. The Senate adopted the conference committee report on May 29, 2015 and HB 910 is expected to be signed by Governor Abbott who has publicly stated he will sign open carry legislation into law. Shortly after the conference committee was adopted, Governor Abbott tweeted: "Open Carry just passed in both the Texas House & Senate. Next destination: My Pen."
