ANCHIA'S SEXUALLY ORIENTED BUSINESS BACKGROUND CHECK BILL PASSES HOUSE  print page

(Austin, TX) - Today on a unanimous vote, the Texas House of Representatives passed Representative Rafael Anchia's House Bill 960, which gives Texas cities access to the FBI's National Crime Information Center (NCIC) criminal history record information when the cities are investigating the background of applicants for, or current holders of, Sexually Oriented Business (SOB) licenses.



Access to the federal database is provided through the Texas Department of Public Safety. Access to the NCIC database would, for the first time, enable cities to find out if applicants for, or holders of, SOB licenses have criminal histories in other states.



"This bill gives cities and counties a much-needed tool in their ongoing effort to protect communities against the bad actors in the sexually oriented business industry." said Representative Anchia. He added, "National and international criminal syndicates take advantage of the limitations imposed on cities and counties by their lack of access to national criminal history information."



The bill was necessary because federal law specifies that for the DPS to share NCIC criminal history information with municipalities or state agencies, language must be written into state law
stating for what specific purpose the information will be used.
